These Terms of Service constitute a legally binding agreement between the customer and Astronomy Tours S. COOP.

By accessing the website, making a booking, or purchasing any product or service, the customer confirms that they have:

  • Read these Terms of Service in full

  • Understood their content

  • Agreed to be legally bound by them

If the customer does not agree with any part of these Terms, they must refrain from:

  • Making a booking

  • Purchasing products

  • Participating in any experience

The services provided by the company involve outdoor, nature-based, and observational activities, which may include inherent risks, environmental variability, and dependence on factors beyond the company’s control.

These Terms should be read in conjunction with:

  • The Privacy Policy (data protection)

  • Any specific conditions stated on individual experience or product pages

  • Any separate agreements for private, corporate, or institutional services

In the event of any conflict:

  • Specific agreements or product-level conditions shall take precedence over these general Terms.

2. Scope of Services

The company provides:

 

  • Stargazing experiences

  • Private events and experiences

  • Educational workshops and programs

  • Maritime and third-party experiences

  • Physical products and merchandise

Depending on the service, the company may act as:

  • Organizer, or

  • Intermediary coordinating third-party services

3. Booking & Payment Terms

  •  Bookings are made via:
    - Official website (Wix / Stripe), or
    - Authorized partners

  • Full payment is required unless stated otherwise

  • Customers are responsible for:
    - Providing accurate information
    - Ensuring all participants included in the booking are informed of the applicable conditions and rules

4. Pricing & Fees

  • Prices are displayed in EUR unless stated otherwise

  • Service and transaction fees are non-refundable

  • Prices may change at any time (excluding confirmed bookings)

5. Cancellation, Refund & Rescheduling Policy

5.1 General

All bookings are subject to the cancellation and refund terms outlined below. By completing a booking, the customer acknowledges and agrees to these terms.

 

Refunds, where applicable, are always issued excluding payment processing fees, service charges, and non-recoverable transaction costs.

 

Unless explicitly stated otherwise in the specific experience or event description, the following policies apply.

5.2 Experiences (Standard Experiences & Private Bookings)

 

For standard experiences (including private bookings unless otherwise specified):

  • More than 14 days before the scheduled experience:
    Customers are eligible for a 100% refund minus applicable service and processing fees.

  • Between 14 days and 48 hours before the scheduled experience:
    Customers are eligible for a 50% refund minus applicable service and processing fees.

  • Less than 48 hours before the scheduled experience:
    No refund will be issued under any circumstances.

  • Failure to attend (no-show):
    Treated as a last-minute cancellation. No refund will be issued.

5.3 Fixed-Date Events & Special Astronomy Events

 

Certain events are classified as fixed-date or special events, including but not limited to:

  • Solar eclipses

  • Rare astronomical phenomena

  • Limited-capacity or one-time scheduled events

For these events:

  • All bookings are strictly non-refundable.

This policy is in accordance with Article 103(l) of Directive 2011/83/EU, which excludes the right of withdrawal for leisure services provided on a specific date or period.

No exceptions will be made for:

  • Personal circumstances

  • Travel disruptions

  • Schedule conflicts

  • Weather conditions

 

5.4 Organizer Cancellation / Force Majeure

 

In the event that the organizer is required to cancel or significantly modify an experience due to circumstances beyond reasonable control, including but not limited to:

  • Weather conditions

  • Safety risks

  • Maritime restrictions

  • Technical issues

  • Insufficient number of participants

  • Force majeure events (including natural disasters, governmental restrictions, or other unforeseen events)

The customer will be offered:

  • A voucher (credit) equivalent to the amount paid, valid for future bookings

To the fullest extent permitted by applicable law, monetary refunds will not be issued in such cases, and the customer will instead receive a voucher (credit) equivalent to the amount paid.

5.5 Vouchers

  • Vouchers are valid for 6 months from:
    - The original experience date, or
    - The date of purchase (if no date was scheduled)

  • Vouchers:
    - Are non-refundable
    - Cannot be exchanged for cash
    - Must be used in a single transaction
    - Cannot be split across multiple bookings

  • Vouchers are valid only for:
    - Regular scheduled experiences

  • Vouchers are not valid for:
    - Add-ons or upgrades
    - Accommodation
    - Merchandise or physical products
    - Private or custom events (unless explicitly agreed)

  • If the new booking:
    - Costs more → the customer pays the difference
    - Costs less → no remaining balance will be refunded

 

5.6 Exceptions & Overrides

 

Specific experiences, events, or third-party services may have custom cancellation terms, which will be clearly stated in their respective descriptions.

 

In such cases, those specific terms take precedence over this general policy.

6. Weather, Visibility & Astronomy Conditions

6.1 Nature of Astronomical Experiences

All experiences provided involve observational astronomy and outdoor activities, which are inherently dependent on natural conditions beyond the control of the organizer.

The customer acknowledges that astronomy is a science-based observational activity, and that visibility of celestial objects is not guaranteed.

6.2 Weather Dependency

All experiences are subject to weather and environmental conditions, including but not limited to:

  • Cloud cover

  • Atmospheric conditions

  • Wind

  • Humidity

  • Sea conditions (for maritime experiences)

These conditions may affect:

  • Visibility of stars, planets, or astronomical phenomena

  • Use of telescopes

  • Overall experience format

6.3 No Guarantee of Visibility

The organizer does not guarantee:

  • Clear skies

  • Visibility of specific celestial objects

  • Visibility of astronomical events (including eclipses, meteor showers, or planets)

  • Darkness levels or sky quality

The customer understands that:

  • Astronomical events may be partially or fully obscured

  • Visibility conditions can change rapidly and unpredictably

6.4 Adapted Experience Policy

In the event of partial or poor visibility conditions, the experience will still be considered delivered if conducted in adapted format, which may include:

  • Guided night sky interpretation (when possible)

  • Use of laser pointers to explain constellations

  • Astronomy storytelling and educational content

  • Big-screen presentation of astronomical objects visible in the sky under conditions similar to the date of the experience

  • Scientific explanations of ongoing phenomena

  • Alternative observational techniques where feasible

Such adapted delivery does not qualify for refund, compensation, or rescheduling.

6.5 Proceeding Under Suboptimal Conditions

Unless conditions pose a direct safety risk, experiences will proceed as scheduled, even if:

  • Visibility is limited

  • Astronomical observation is reduced or not possible

Customer dissatisfaction based on:

  • Weather conditions

  • Visibility limitations

  • Astronomical expectations

does not constitute valid grounds for refund or compensation.

6.6 Maritime & Horizon-Based Observations

For experiences conducted at sea or involving horizon-based observations (e.g. sunsets, eclipses):

  • Visibility depends on:

  • Horizon clarity

  • Sea conditions

  • Atmospheric transparency

The organizer does not guarantee:

  • Unobstructed horizon views

  • Visibility of sunset or celestial alignment events

These factors are outside the organizer’s control and do not constitute grounds for refund.

6.7 Scientific & Natural Variability

The customer acknowledges that:

  • Astronomical phenomena follow natural laws and may vary in appearance

  • Perceived intensity, brightness, or visibility may differ from:
    - Media representations
    - Personal expectations
    - Promotional materials

No refund or compensation will be provided based on subjective perception of the experience.

7. Third-Party Services

7.1 Use of Third-Party Providers

Certain experiences offered by the company may involve services provided by third parties, including but not limited to:

  • Boat and maritime operators

  • Event venues and accommodation providers

  • Transport providers

  • External instructors or collaborators

These services are delivered under independent third-party responsibility.

7.2 Role of the Company

Depending on the experience, the company may act as:

  • The organizer, or

  • An intermediary or coordinator facilitating access to third-party services

Where third-party services are involved, the company does not act as the direct provider of those specific services unless explicitly stated.

7.3 Third-Party Responsibility

All third-party providers:

  • Operate under their own licenses, insurance, and legal obligations

  • Are solely responsible for:
    - The delivery of their services
    - Safety compliance
    - Operational decisions

7.4 Limitation of Liability for Third-Party Services

The company shall not be held liable for:

  • Any act, omission, or negligence of third-party providers

  • Injury, loss, damage, delay, or inconvenience caused by third-party services

  • Cancellation, modification, or failure of third-party services

Any claims related to third-party services must be addressed directly with the respective provider, where applicable.

7.5 Additional Terms of Third Parties

Customers acknowledge that:

  • Third-party providers may have their own terms and conditions

  • Participation in such services may be subject to those additional terms

By booking an experience involving third parties, the customer agrees to comply with any applicable third-party rules and policies.

8. Participant Responsibilities & Conduct

8.1 General Conduct

Participants are expected to behave in a respectful, responsible, and cooperative manner at all times.

Any behavior that:

  • Disrupts the experience

  • Compromises safety

  • Negatively affects other participants, staff, animals, or the environment

 

may result in immediate removal without refund.

8.2 Pre-Booking Responsibility & Awareness

By completing a booking, the customer confirms that:

  • They have read and understood these Terms of Service

  • They have reviewed all experience details and conditions prior to purchase

  • They have ensured that all participants under the same booking are:
    - Informed of the rules
    - Aware of the nature of the experience
    - Willing and able to comply

Failure to review or understand the conditions does not constitute grounds for refund or complaint.

8.3 Compliance with Instructions

Participants must:

  • Follow all instructions provided by:
    - Guides
    - Staff
    - Third-party providers

Failure to comply may result in:

  • Restricted participation, or

  • Immediate removal

 

No refund or compensation will be provided in such cases

8.4 Punctuality & Late Arrival Policy

Participants are responsible for arriving on time at the designated meeting point.

  • Late arrivals may be refused participation

  • Experiences (especially fixed departures such as cruises) will not be delayed

 

If a participant expects to arrive late:

  • They must notify the organizer in writing via WhatsApp or email prior to the start time

Failure to notify:

  • May result in denied entry with no refund

In all cases:

  • Late arrival does not entitle the participant to:
    - Refund
    - Rescheduling
    - Compensation

8.5 Responsibility for Personal Belongings

Participants are solely responsible for:

  • Their personal belongings

  • Any equipment they bring

The company accepts no liability for:

  • Loss

  • Theft

  • Damage

8.6 Appropriate Clothing & Preparation

Participants are responsible for:

  • Wearing suitable clothing and footwear

  • Preparing for:
    - Outdoor conditions
    - Nighttime environments
    - Weather variability

The organizer is not responsible for:

  • Discomfort

  • Inconvenience

  • Inability to participate due to lack of preparation

8.7 Alcohol, Substances & Behaviour

Participants must not:

  • Attend under the influence of drugs

  • Engage in unsafe, aggressive, or disruptive behaviour

Where alcohol is permitted:

  • It must be consumed responsibly

The organizer reserves the right to:

  • Refuse or terminate participation of any individual behaving unsafely

 

In such cases:

 

  • No refund will be issued

8.8 Damage to Equipment or Property

Participants are responsible for any damage caused to:

  • Telescopes

  • Equipment

  • Facilities

  • Third-party property

The company reserves the right to:

  • Seek full compensation for damages resulting from:
    - Misuse
    - Negligence
    - Intentional actions

8.9 Minors & Supervision

  • Minors must be accompanied by a responsible adult unless explicitly stated otherwise

  • The accompanying adult assumes full responsibility for:
    - Safety
    - Behaviour
    - Compliance

Children must be supervised at all times.

The organizer reserves the right to:

  • Limit or terminate participation of:
    - A minor, or
    - The entire group

in case of disruptive or unsafe behaviour.

Parenting approaches do not override safety or operational rules.

 

No refund will be issued in such cases

8.10 Venue Conditions & Environmental Awareness

Participants acknowledge that experiences may take place in natural, rural, or specialized environments, which may include:

  • Uneven terrain

  • Limited infrastructure

  • Restricted access to utilities

  • Presence of animals

Participants are responsible for ensuring that they:

  • Are comfortable with such conditions

  • Do not have:
    - Severe allergies
    - Phobias
    - Limitations incompatible with the environment

Failure to assess suitability does not qualify for refund or compensation.

8.11 Compliance with Venue-Specific Rules

Certain locations (including but not limited to private venues, rural properties, or partner facilities) may have additional rules and restrictions.

These may include:

  • Environmental protection measures

  • Animal interaction restrictions

  • Resource usage limitations

  • Food and drink policies

Participants agree to:

  • Fully comply with such rules at all times

Violation may result in:

  • Immediate removal from the experience

  • No refund or compensation

8.12 Right to Refuse Service

The company reserves the right to:

  • Refuse participation

  • Remove any participant at any time

if:

  • Safety is compromised

  • Rules are not followed

  • Behaviour is inappropriate

This decision remains at the sole discretion of the organizer.

No refund or compensation will be provided

9. Liability Limitation

9.1 Participation at Own Risk

All experiences are undertaken voluntarily and at the participant’s own risk.

By attending, the customer acknowledges that:

  • Activities take place in outdoor, low-light, and natural environments

  • Certain inherent risks cannot be eliminated

9.2 Assumption of Risk

Participants expressly accept the risks associated with:

  • Walking in dark or uneven terrain

  • Exposure to natural elements (weather, temperature, insects, etc.)

  • Use of telescopes and optical equipment

  • Maritime environments, including boarding, disembarking, and movement on vessels

  • Optional activities such as swimming (where applicable)

9.3 Limitation of Liability

To the fullest extent permitted by law, the company shall not be held liable for:

  • Personal injury or accidents occurring during the experience

  • Loss, theft, or damage to personal belongings

  • Delays, interruptions, or changes caused by external factors

  • Actions, omissions, or negligence of third-party providers

This limitation applies unless the damage is caused by:

  • Proven gross negligence, or

  • Intentional misconduct by the organizer

9.4 Third-Party Services

Where services are provided by third parties (including but not limited to boat operators, venues, or transport providers):

  • Such parties operate under their own licenses, insurance, and legal responsibility

  • The company acts solely as:
    - An intermediary, or
    - A coordinating entity

The company shall not be held liable for:

  • Incidents occurring under the responsibility of third-party providers

  • Failure of third-party services to perform as expected

9.5 Health & Fitness Responsibility

Participants are responsible for ensuring that they:

  • Are physically and medically fit to attend the experience

  • Do not have conditions that may be aggravated by:
    - Outdoor environments
    - Nighttime activities
    - Maritime conditions

The company accepts no liability for health-related issues arising during or after participation.

9.6 Safety Compliance

Participants must:

  • Follow all instructions provided by staff and guides

  • Comply with safety rules at all times

The organizer reserves the right to:

  • Remove any participant who:
    - Fails to comply with safety instructions
    - Poses a risk to themselves or others

In such cases:

  • No refund will be issued

9.7 Alcohol & Behaviour

Where alcohol is available (e.g. cruises or events):

  • Consumption is at the participant’s own responsibility

  • The company is not liable for:
    - Incidents resulting from intoxication
    - Unsafe or inappropriate behaviour

Participants behaving in a disruptive, unsafe, or abusive manner may be removed without refund.

9.8 Force Majeure & Uncontrollable Events

The company shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including:

  • Weather conditions

  • Natural disasters

  • Government restrictions

  • Maritime or port authority decisions

  • Technical failures

10. Vouchers & Credits

10.1 General Use

Vouchers and credits issued by the company:

  • Represent a non-cash, non-refundable value

  • Can only be used for booking eligible experiences offered by the company

  • Cannot be exchanged for money under any circumstances

10.2 Types of Vouchers

Vouchers may be issued in the following forms:

a) Purchased Vouchers
  • Bought directly via the website or authorized channels

  • May be:
    - Fixed-date vouchers (for a specific experience/date), or
    - Open vouchers (redeemable within a validity period)

Unless otherwise stated:

  • All purchased vouchers are valid for 6 months from the date of purchase

Certain promotional or special vouchers may:

  • Include specific services or add-ons (e.g. overnight stay)

  • Be subject to additional conditions clearly stated at the time of purchase

b) Compensation Vouchers (Credits)

Issued in cases where:

  • An experience is cancelled by the organizer (see Section 5)

These vouchers:

  • Are issued for the value of the original booking

  • Follow the same usage rules as standard vouchers unless otherwise specified

10.3 Validity

  • Vouchers are valid for 6 months from:
    - Date of purchase (for purchased vouchers), or
    - Original experience date (for compensation vouchers)

Expired vouchers:

  • Become void automatically

  • Are not refundable, extendable, or reactivated

10.4 Redemption Process

  • Each voucher includes a unique code

  • This code must be entered during the online booking process

Important:

  • All bookings must be made online

  • Vouchers cannot be redeemed:
    - On-site
    - Via informal communication channels

A booking is only confirmed once:

  • The voucher code has been successfully applied, and

  • The reservation process is completed through the official system

10.5 Usage Conditions

  • Vouchers:
    - Must be used in a single transaction
    - Cannot be split across multiple bookings

  • If the selected experience:
    - Costs more than the voucher value → the customer must pay the difference
    - Costs less than the voucher value → no remaining balance will be refunded

10.6 Restrictions

Unless explicitly stated otherwise, vouchers:

  • Are valid only for regular scheduled experiences

  • Are not valid for:
    - Private events
    - Custom bookings
    - Add-ons or upgrades
    - Merchandise or physical products

10.7 Transferability

  • Vouchers may be transferred to another person unless otherwise specified

  • The company is not responsible for:
    - Lost, stolen, or misused voucher codes

10.8 Misuse & Fraud Prevention

The company reserves the right to:

  • Refuse voucher use in case of:
    - Suspected misuse
    - Fraudulent activity
    - Violation of these Terms

11. Products (Physical Goods & Merchandise)

11.1 Scope

This section applies to all physical products and merchandise sold by the company, including but not limited to:

  • Clothing (e.g. apparel)

  • Astronomy equipment and accessories

  • Educational materials and kits

11.2 Order Processing

  • Orders are processed upon successful payment

  • Delivery times are estimates and may vary depending on:
    - Location
    - Carrier
    - Availability

The company is not liable for:

  •  Delays caused by shipping providers

  • Customs or import-related issues

11.3 Returns – Damaged or Defective Products Only

Products may be eligible for return only if they are received damaged or defective.

To request a return:

  • The customer must notify the company within 48 hours of delivery

  • Proof must be provided:
    - Photos of the product
    - Photos of packaging

If approved:

  • The product may be:
    - Replaced, or
    - Refunded at the company’s discretion

11.4 Non-Returnable Items

Returns and refunds will not be accepted in the following cases:

  • The product has been:
    - Opened
    - Used
    - Worn

  • The customer has changed their mind

  • Incorrect size or preference (unless explicitly stated otherwise in product description)

11.5 Hygiene & Safety Policy

For hygiene and safety reasons:

  • Certain items (e.g. apparel, personal-use products)
    are non-returnable once opened or used

11.6 Right of Withdrawal (EU Compliance Notice)

Nothing in this section limits any mandatory statutory rights that cannot be excluded under applicable consumer law.

Where applicable under EU consumer law, customers may have a right of withdrawal.

However, this right does not apply to:

  • Goods that have been:
    - Unsealed after delivery
    - Used or worn
    - Not in original condition

By completing a purchase, the customer acknowledges and accepts these limitations.

11.7 Responsibility Upon Delivery

  • Responsibility for the product transfers to the customer upon delivery

  • Customers must ensure:
    - Correct shipping address
    - Ability to receive the package

The company is not responsible for:

  • Failed delivery due to incorrect information

  • Uncollected packages

11.8 Refund Processing

If a refund is approved:

  • It will be issued using the original payment method

  • Processing times may vary depending on the payment provider

Shipping costs:

  • Are non-refundable, unless the product is defective

12. Intellectual Property

12.1 Ownership of Content

All content provided by the company, including but not limited to:

  • Texts, descriptions, and materials

  • Photographs, videos, and graphics

  • Educational content, presentations, and workshop materials

  • Audio, recordings, and visual outputs

  • Branding, logos, trademarks, and visual identity

is the exclusive property of the company or its licensors and is protected by applicable intellectual property and copyright laws.

12.2 Permitted Use

Customers are granted a limited, non-exclusive, non-transferable, revocable license to:

  • Access and view content for personal, non-commercial use only

  • Participate in experiences and educational activities

This license does not grant any ownership rights.

12.3 Prohibited Use

Without prior written consent, it is strictly prohibited to:

  • Copy, reproduce, distribute, publish, or display any content

  • Record (audio, video, or otherwise) experiences, workshops, or educational sessions for anything other than strictly personal use

  • Transmit, share, or upload content publicly or commercially

  • Use any materials for:
    - Commercial purposes
    - Training, teaching, or educational delivery
    - Competing or similar services

  • Modify, adapt, translate, or create derivative works

  • Use content for AI training, automated data extraction, or machine learning purposes

12.4 Educational Content Protection

All educational and scientific content delivered during:

  • Stargazing sessions

  • Workshops

  • Courses

  • Institutional or outreach programs

is proprietary.

Participants may not:

  • Record sessions for redistribution or publication

  • Reuse or replicate content for teaching, guiding, or commercial activities

  • Present derived knowledge as their own professional or commercial offering

12.5 Brand & Identity Protection

Use of the company’s:

  • Name

  • Logo

  • Brand identity

  • Program names (including Astronomy Tours, JustStargaze, Finca Astronómica, etc.)

is strictly prohibited without prior written approval.

This includes use in:

  • Marketing

  • Events

  • Commercial listings

  • Online platforms

12.6 Participant-Created Content

Participants may take personal photos and videos unless otherwise restricted.

However:

  • Such content may only be used for personal, non-commercial purposes

  • Any commercial use (including promotion, resale, or monetization) requires prior written consent

Participants may not:

  • Misrepresent the experience

  • Use content in a way that damages the company’s reputation or brand

12.7 Enforcement

The company reserves the right to:

  • Take legal action in case of infringement

  • Request removal of unauthorized content

  • Restrict future participation in services

13. Modifications to Services

13.1 Right to Modify

The company reserves the right to modify, adjust, or update any aspect of an experience or service at any time, including but not limited to:

  • Schedule and start time

  • Duration

  • Location or meeting point

  • Program structure and sequence

  • Content, format, or delivery method

Such modifications may occur due to:

  • Operational requirements

  • Weather or environmental conditions

  • Astronomical conditions

  • Safety considerations

  • Third-party dependencies

  • Unforeseen circumstances

13.2 Nature of the Experience

Participants acknowledge that:

  • Experiences are dynamic and condition-dependent

  • Certain elements may vary from descriptions due to real-world factors

Descriptions provided:

  • Are indicative in nature

  • Do not constitute a fixed or guaranteed program

13.3 Substitution of Elements

The company reserves the right to:

  • Replace, adapt, or omit specific elements of an experience

  • Introduce alternative components of similar nature, educational value, or intent

Such substitutions:

  • Do not constitute a cancellation

  • Do not entitle the participant to refund, compensation, or rescheduling

13.4 Schedule Adjustments

Start times and durations may be modified due to:

  • Seasonal variations

  • Astronomical timing (e.g. sunset, celestial events)

  • Operational considerations

Participants are responsible for:

  • Checking the latest confirmed details prior to attendance

Failure to do so:

  • Does not qualify for refund or compensation

13.5 Location Changes

The company may change the location of an experience when necessary for:

  • Safety reasons

  • Weather conditions

  • Visibility optimization

  • Operational or logistical constraints

Participants acknowledge that:

  • Location flexibility is an inherent part of the service

Such changes:

  • Do not qualify for refund or compensation

13.6 Third-Party Dependencies

Where experiences involve third-party providers:

  • Modifications may occur due to their operational decisions

The company:

  • Is not responsible for changes imposed by third parties

  • Will make reasonable efforts to adapt the experience accordingly

13.7 Partial Changes vs Cancellation

A modification affecting:

  • Format

  • Content

  • Conditions

  • Scope of certain elements

does not constitute a cancellation if the experience is substantially delivered.

In such cases:

  • No refund, compensation, or rescheduling applies

13.8 Participant Acknowledgment

By booking, participants explicitly acknowledge and accept that:

  • Flexibility and adaptation are integral to the nature of the services

  • Variations from initial descriptions may occur

14. General Safety & Participation Conditions

14.1 Personal Responsibility

Participants are responsible for:

  • Their own safety and wellbeing

  • Making informed decisions regarding participation

They must ensure that they:

  • Are physically and mentally fit

  • Do not have conditions incompatible with:
    - Outdoor environments
    - Nighttime activities
    - Maritime conditions (if applicable)

14.2 Assumption of Risk

Participants acknowledge that experiences may involve:

  • Uneven terrain

  • Limited lighting

  • Weather exposure

  • Venue-specific rules

Failure to comply may result in:

 

  • Removal without refund

14.5 Health & Medical Conditions

Participants are responsible for:

  • Informing themselves of any risks

  • Taking necessary precautions

The company is not responsible for:

  • Medical issues arising during or after participation

14.6 Insurance

Participants are responsible for obtaining any:

  • Personal insurance

  • Travel insurance

if deemed necessary.

The company does not provide individual insurance coverage unless explicitly stated.

14.7 Responsibility for Group Bookings

The person making the booking:

  • Acts on behalf of all participants included

  • Is responsible for ensuring:
    - All participants are informed of these Terms
    - All participants comply with them

15. Finca Astronómica & Special Venue Rules

15.1 Nature of the Venue

Finca Astronómica is a private, rural, off-grid, and environmentally protected property operated under strict sustainability and operational guidelines.

By booking an experience at this venue, participants acknowledge and accept that:

  • The environment is natural, non-urban, and uneven, with gravel and rural terrain

  • The finca operates under off-grid systems, including:
    - Limited electricity
    - Controlled water usage
    - Ecological waste management

This venue is not comparable to standard hospitality or hotel facilities, and guests must adjust expectations accordingly.

15.2 Accessibility & Infrastructure Limitations

Participants acknowledge that:

  • The venue is not wheelchair accessible in full, however:
    - Mobile wheelchair users may participate at their own responsibility, understanding that most surfaces are gravel and uneven

  • There is no wheelchair-accessible toilet

  • A toilet facility is available within approximately 20 meters from sleeping areas

  • No showers are available anywhere on the property

Electricity & utilities:

  • Only low-consumption devices (e.g. phone chargers) are permitted

  • Use of high-consumption appliances is strictly prohibited

 

Water & sanitation:

  • Only toilet paper may be disposed of in toilets due to ecological septic systems

Failure to accept these conditions does not qualify for refund or complaint.

15.3 Environmental & Sustainability Rules

Finca Astronómica operates under strict environmental principles.

Participants must:

  • Respect the natural environment

  • Follow all instructions related to:
    - Water conservation
    - Waste management
    - Energy usage

The finca includes gardens and cultivated areas:

  • Guests are strictly forbidden from:
    - Picking fruit
    - Cutting plants or trees
    - Interfering with vegetation

Violation may result in:

  • Removal from the premises

  • Liability for damages

  • No refund

15.4 Rural Conditions & Natural Environment

Participants acknowledge and accept that:

  • The rural environment may include:
    - Animal hair
    - Insects (e.g. bees, snails, bugs)
    - Reptiles (e.g. small lizards) and natural traces

The finca is regularly cleaned and sanitised; however, full control of natural elements is not possible

Guests must also accept:

  • Natural sounds, including but not limited to:
    - Roosters
    - Peacocks
    - Guinea fowls
    - Dogs (including nearby farm dogs)

Additionally:

  • At certain times, there may be natural or agricultural odors in the air due to:
    - Nearby farms
    - Soil fertilisation

These are normal rural conditions and do not constitute grounds for complaint or refund.

15.5 Animals on Site

The finca is a working rural property with:

  • Enclosed farm animals

  • Free-roaming animals (including poultry and cats)

Participants must:

  • Not feed, touch, chase, or disturb animals

  • Respect all fences and boundaries

The company is not liable for incidents resulting from:

  • Guest misconduct

  • Failure to follow instructions

Any harm caused to animals may result in:

  • Removal

  • Liability for damages

15.6 Resident Working Dogs

The finca is home to trained German Shepherd dogs that:

  • Move freely across the property

  • Assist in:
    - Guest guidance
    - Night safety
    - Perimeter monitoring

Participants must:

  • Remain calm and respectful

  • Not interact, feed, or command the dogs

By entering the property, guests accept their presence as part of the environment.

The company is not liable for incidents caused by:

  • Guest interference

  • Fear, panic, or inappropriate behaviour around animals

15.7 Visiting Dogs (Pet Policy)

Dogs are permitted under strict conditions:

  • Must be declared at booking

  • Must remain on leash at all times

  • Must not relieve themselves within the finca grounds:
    - Owners must walk dogs outside the main area
    - Waste must be collected

Important:

  • The finca contains:
    - Free-roaming animals
    - Working dogs

If a visiting dog:

  • Is fearful of other animals, or

  • Causes disturbance

The finca accepts no responsibility, and no refund will be issued

Additional rules:

  • No aggressive behaviour

  • No access to:
    - Food areas
    - Telescope zones

  • Not allowed on furniture

Overnight stays:

  • Personal dog bedding required

  • Dogs must not be left unattended

The finca accepts dogs, but is not a dog-focused facility

15.8 Telescope & Equipment Use

All astronomical equipment is professional and sensitive.

 

Rules:

  • Telescopes are operated exclusively by staff

  • Guests must not:
    - Touch
    - Move
    - Adjust equipment

  •  Rule: “Observe with your eyes, not with your hands.”

Additionally:

  • No food or drinks near equipment

  • No running or disruptive behaviour

  • Children allowed only under strict supervision

Any damage caused will result in full financial liability.

15.9 Light & Observation Rules

To preserve night vision and observation quality and safety:

  • White lights and flash photography are prohibited

  • Screens must be minimized

Recommended:

  • Red-light flashlights

Failure to comply may restrict participation.

15.10 Food & Beverage Policy

  • Bringing outside food or drinks is not permitted

Where meals are included:

  • They are provided as part of the experience due to timing and location constraints

  • This does not constitute restaurant service

  • Food is not the primary focus of the experience

Special dietary needs:

  • Must be requested in advance

  • Can be accommodated only if pre-arranged

15.11 Additional Services & Overnight Stays

  • Overnight stays must be booked in advance

  • They are considered an extension of the astronomical experience, not a standalone accommodation service

Operational rules:

  • Check-in: at event start

  • Check-out: typically between 10:00–11:00 (unless otherwise stated)

  • Night silence must be respected after the program

15.12 Accommodation (Yurts & Glamping Pods)

Accommodation is:

  • Camping-style, compact, and minimalist, designed to complement the astronomical experience rather than provide hotel-level comfort

Units:

  • Are small in size

  • Include:
    - Heating in winter
    - Fans in summer

Rules:

  • No food or drinks (except water) inside units

  • No external appliances

  • Bedding is provided, however:
    - Guests with special requirements must arrange their own

Additional:

  • No showers available

  • Night silence required after the program

  • Units must not house finca animals

  • Additional observations may take place during various hours of the night. Although performed with respect to the night silence, some noise is unavoidable.

15.13 Events, Celebrations & Group Behaviour

Open/public experiences:

  • Are not intended for celebrations

Strictly prohibited:

  • Birthdays

  • Bachelor/bachelorette parties

  • Decorations, cakes, gifts, confetti

Groups wishing to celebrate must book private experiences.

This rule applies to all bookings:

  • No party-style setups allowed under any circumstances

  • The venue maintains a quiet, natural, and astronomical atmosphere

 

Violation may result in:

  • Immediate removal

  • No refund

15.14 Arrival & Access Rules

  • Guests must not arrive before the official start time

  • The finca remains closed until start time

Late arrivals:

  • Must send a written message (WhatsApp or email)

  • Must wait at the gate until staff assistance

  • May not be allowed entry

Guests may not:

  • Enter the property independently

Guests are required to register upon entry.

Entry is not guaranteed if late.

15.15 Movement & Safety at Night

  • Movement takes place in low-light conditions

  • Participants must move carefully and follow staff guidance

The organizer is not responsible for incidents resulting from a participant’s failure to follow safety instructions.

15.16 Staff Role & Experience Nature

Staff are:

  • Astronomers and educators

They are not:

  • Entertainers

  • Event hosts

  • Childcare providers

The experience is educational and observational in nature.

Participants are expected to align with this format.

15.17 Children & Supervision

  • Children must be supervised at all times

  • No childcare or entertainment services are provided

Disruptive behaviour (child or adult):

  • May result in removal of:
    - The individual, or
    - The entire group

  •  No refund will be issued.

Parenting approaches do not override safety or operational rules.

15.18 Bonfire Policy

Where included:

  • Bonfires are subject to:
    - Weather conditions
    - Safety regulations

They may be:

  • Modified or cancelled at any time

 

No compensation will be provided if a bonfire is not possible due to safety or operational conditions.

15.19 Educational Context

The finca participates in:

  • European educational and training programs

  • Other forms of training activities

Supervised trainees and under-age assistants may be present.

15.20 Neutral Environment Policy

The experience is a neutral educational space.

  • No political or ideological discussions are conducted

Participants must respect this environment.

15.21 Multiple Groups & Operations

  • Multiple experiences may run simultaneously

  • Each group must:
    - Follow its assigned guide
    - Respect the structure of the program​

16. Photo, Video & Media Release

16.1 Consent to Capture Media

By participating in any experience, event, or activity, participants acknowledge that photographs, videos, and other media may be captured during the experience and consent to their use in accordance with this Section 16.

This applies to:

  • Group settings

  • Background appearances

  • General atmosphere documentation

16.2 Use of Media

The company reserves the right to use such media for:

  • Marketing and promotional purposes

  • Website content

  • Social media

  • Advertising campaigns

  • Printed and digital materials

This use is:

  • Worldwide

  • Non-exclusive

  • Without time limitation

16.3 No Compensation

Participants acknowledge that:

  • No financial compensation, royalties, or other payment will be provided for the use of such media

16.4 Respectful Use

The company commits to:

  • Using media in a respectful and professional manner

  • Avoiding use of images that may:
    - Harm dignity
    - Misrepresent participants

16.5 Opt-Out Procedure

Participants who do not wish to appear in photos or videos must:

  • Inform the organizer in writing prior to the start of the experience (via email or WhatsApp)

The company will make reasonable efforts to:

  • Avoid capturing or using identifiable images of those participants

However:

  • Complete exclusion cannot be guaranteed in group environments

16.6 Incidental Appearance

Participants acknowledge that:

  • In public or group settings, they may appear incidentally in background media

  • Such incidental inclusion does not constitute a violation of rights

16.7 Participant-Captured Media

Participants are allowed to take personal photos and videos unless otherwise restricted.

However:

  • Commercial use of such content requires prior written consent from the company

17. Privacy & Data Protection (GDPR)

17.1 Data Processing

The company processes personal data in accordance with applicable data protection laws, including:

  • Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR)

Personal data may be collected through:

  • Booking forms

  • Website interactions

  • Payment processing systems (e.g. Wix, Stripe)

  • Direct communication (email, WhatsApp, etc.)

17.2 Purpose of Data Use

Personal data is used for:

  • Processing bookings and payments

  • Managing participation in experiences

  • Customer communication

  • Legal and administrative obligations

  • Improving services and customer experience

Personal data is retained only for as long as necessary to fulfil operational, legal, and administrative obligations.

17.3 Third-Party Processing

Data may be processed by trusted third parties, including:

  • Payment providers (e.g. Stripe)

  • Website platforms (e.g. Wix)

  • Operational partners where necessary

These providers operate under their own privacy and security standards.

17.4 Data Protection Rights

Participants have the right to:

  • Access their personal data

  • Request correction or deletion

  • Restrict or object to processing

  • Request data portability

Requests must be submitted via the official contact email.

17.5 Privacy Policy

Full details regarding data collection, storage, and protection are outlined in the company’s Privacy Policy, which forms an integral part of these Terms.

18. Programs & Institutional Services

18.1 Scope

The company offers specialized programs, including but not limited to:

  • Corporate experiences and events

  • Educational programs for schools and institutions

  • Outreach initiatives (including Astronomy Without Borders and similar projects)

18.2 Separate Agreements

Such programs may:

  • Be subject to custom agreements, contracts, or proposals

  • Include specific terms, pricing, and operational conditions

In case of conflict:

 

The specific agreement takes precedence over these Terms of Service

18.3 Institutional Nature

Participants acknowledge that certain programs:

  • May be educational, scientific, or institutional in nature

  • May follow structured formats and guidelines different from standard experiences

19. Governing Law & Jurisdiction

These Terms of Service are governed by and interpreted in accordance with:

  • The laws of Spain

Any disputes arising in connection with these Terms shall be subject to:

  • The exclusive jurisdiction of the courts of Murcia, Spain

20. Final Provisions

20.1 Modifications

The company reserves the right to:

  • Update or modify these Terms at any time

The applicable version is:

  • The one in force at the time of booking

​20.2 Severability

If any provision of these Terms is found to be:

  • Invalid or unenforceable

The remaining provisions shall remain fully valid and enforceable.

20.3 Language Discrepancies

In case of discrepancies between translated versions of these Terms, the English version shall prevail

20.4 Acceptance of Terms

By completing a booking or purchase, the customer confirms that they:

  • Have read

  • Understood

  • Accepted

these Terms of Service in full.

20.5 Entire Agreement Clause

These Terms constitute the entire agreement between the company and the customer and supersede any prior communications or agreements.
